The viral fantasy film "cocаine Bear" tells the story of a bear that becomes intoxicated with cocаine. It is based on a true incident in which a bear died after ingesting a bag of cocаine. In the movie, the bear develops an addiction and wreaks havoc in a forest.



The UDRP case revolves around a dispute between Kentucky for Kentucky LLC (the "Complainant") and Camp Zinc (the "Respondent") regarding the domain name cocаineBear.com.

The Complainant asserts rights to the cocаinE BEAR trademark through registration with the USPTO and seeks the transfer of the domain name.

However, the panelist concludes that the Complainant has not provided enough evidence to support their claim, resulting in the denial of the request to transfer the domain name. The Respondent has not submitted a response in this case.

Consequently, not even a UDRP can put an end to the notorious cocаine Bear.

The disputed domain name is registered with Domain.com, LLC.

The assigned Panelist, Alan L. Limbury, certifies that he has acted independently and impartially and has no known conflict while serving as the Panelist in this proceeding.

PROCEDURAL HISTORY

On February 9, 2023, the Complainant electronically submitted a Complaint to Forum, with payment received on the same day.

Domain.com, LLC confirmed via email on February 9, 2023, that the domain name is registered with them and that the Respondent is the current registrant. Furthermore, Domain.com, LLC has verified that the Respondent has agreed to resolve domain disputes according to ICANN's Uniform Domain Name Dispute Resolution Policy (the "Policy").

On February 13, 2023, Forum served the Complaint and all relevant annexes, including a Written Notice of the Complaint. The deadline for the Respondent to file a response was set for March 6, 2023. The Notice was sent via email to all technical, administrative, and billing contacts listed in the Respondent's registration, as well as to postmaster@cocаinebear.com. Additionally, on February 13, 2023, the Written Notice of the Complaint was transmitted to the Respondent via post and fax, addressing all entities and individuals listed in the Respondent's registration as technical, administrative, and billing contacts.

Since no response was received from the Respondent, Forum sent a Notification of Respondent Default to both parties.

On March 11, 2023, following the Complainant's request for a single-member Panel, Alan L. Limbury was appointed as the Panelist by Forum.

After reviewing the communication records, the Administrative Panel finds that Forum fulfilled its responsibility under Paragraph 2(a) of the Rules for Uniform Domain Name Dispute Resolution Policy (the "Rules") by employing reasonable means to provide actual notice to the Respondent through Electronic and Written Notices, as defined in Rule 1 and Rule 2. Therefore, the Panel may issue its decision based solely on the submitted documents, in accordance with ICANN Policy, ICANN Rules, Forum's Supplemental Rules, and any applicable rules and legal principles deemed appropriate by the Panel, without considering any response from the Respondent.

RELIEF SOUGHT

The Complainant requests the transfer of the domain name from the Respondent to the Complainant.
